Some define it like this;

  • To bother, interfere with, or annoy
  • To make indecent sexual advances to
  • To assault sexually
  • To disturb, interfere with, or annoy
  • To subject to unwanted or improper sexual activity

Others like this;
"to cause trouble, grief, or vexation," from O.Fr. molester (12c.), from L. molestare "to disturb, trouble, annoy," from molestus "troublesome," perhaps related to moles "mass" on notion of either "burden" or "barrier." Meaning "sexually assault" first attested 1950. Molestation meant "the harassing of a person in his possession or occupation of lands" in Scot. law from 1456; in Eng. common law it came to mean "injury inflicted upon another."

Some tell it like this;
Child sexual abuse refers to sexual abuse of a child by an adult or some other person significantly older or in a position of power or control over the child, where the child is used for sexual stimulation of another person. In addition to overt sexual interactions, child sexual abuse also includes invitations or requests by an adult regarding sexual forms of kissing, hugging and any other sexual activities Molestation occurs when an adult or person significantly older than a child engages in sexual activity with a minor. The abuse can be over an extended period of time, or a one time incident, and includes touching, fondling, kissing in a sexual manner, oral sex, masturbation, digital or penile penetration of rectum or vagina.

Synonyms - harass, harry, trouble, plague, hector, torment.

Molestation occurs when an adult or person significantly older than a child engages in sexual activity with a minor. The abuse can be over an extended period of time, or a one time incident, and includes touching, fondling, kissing in a sexual manner, oral sex, masturbation, digital or penile penetration of rectum or vagina.

THE SEXUAL OFFENCES BILL SINCE 2006

Since August 2006 rape is no longer defined only as forceful penile penetration of the vagina, but now also includes sexual penetration of the sexual organs, the anus and the mouth. As defined by the bill, "sexual penetration" includes any act which causes penetration to any extent whatsoever by-

  • the genital organs of one person into or beyond the genital organs, anus, or mouth of another person;
  • any other part of the body of one person or, any object, including any part of the body of an animal, into or beyond the genital organs or anus of another person; or
  • the genital organs of an animal, into or beyond the mouth of another person.


Therefore, for the first time in South Africa, if a man or woman does not consent to sex, it is considered rape. This also applies to having sex with a child, someone who was unconscious and the mentally disabled. Child here refers to anyone below the age of 12 because by law a child under the age of 12 cannot consent to sex.
